Why don't you consider that torture? He's thrashing, howling, writhing in pain. We know what the curse is like, because Harry's felt it - and we've already agreed Harry is effective with dark magic.
Certainly nothing like what happened to the students at Hogwarts or what happened to Hermione at the Malfoy Manor.
You could make an argument that the students suffered long-lasting pyschological torture, I suppose. But what on earth makes it different from what Hermione suffered? Hermione and Carrow both had the Cruciatus curse cast on them by members of the other side.
